Is Chapter 7 Bankruptcy Right for Me?
Chapter 7 is known as the liquidation chapter. While bankruptcy is a viable solution for many people, it is not for everyone. There are many factors to consider if you are considering filing for bankruptcy, as well as a means test that you will need to take. A means test helps to determine whether you are eligible based on your assets and income.
If you are more than $20,000 in debt, this may be the solution that fits your needs, while clients with less than $20,000 in debt should consider debt settlement instead.
Chapter 7 bankruptcy might be right for you if the following statements are true:
- You have significant medical bills you cannot repay
- You have credit card debt which is unmanageable
- You don't have much equity in your home
- You don't have significant valuable assets to lose
- You are unable to pay back personal loans
- You are currently unable to drive due to motor vehicle surcharges
Do I Qualify for Chapter 7?
Any person who owns property can file for Chapter 7 bankruptcy, however, in order for your debt to be discharged, you must meet several requirements:
- You must pass the “means” test.
- You have not already filed a previous bankruptcy within a certain period.
- The bankruptcy court must not believe you are cheating creditors.
- You must be a natural person.
What is the Means Test?
The means test determines whether or not you have enough disposable income to repay some of your debts over a five-year period. This means the monthly paycheck you receive should be enough to pay a portion of your debts after subtracting specific expenses.
Chapter 7 -- Who Can't File?
You cannot file for Chapter 7 bankruptcy if you already obtained a debt discharge within the last eight years or a Chapter 13 case within the last six years. You also cannot file if a previous Chapter 7 case of yours was dismissed within the last 180 days for these reasons:
- You violated a court order.
- The bankruptcy court decided that your case was filed fraudulently.
- You requested a dismissal
